Returns/Cancellations

Unopened returns are accepted within 15 days of receipt of the product. There is a 20% restocking fee that is applied as soon as the order is shipped, and the original shipping cost is not refunded. Acceptance of returns outside of the 15 day window is subject to the discretion of DSX Tuning, and if accepted will incur a higher restocking fee. The cost of return shipping is paid by the customer. "Unopened" is defined as the original packaging has not been disturbed (a flex fuel kit was not taken out of the sealed bag, a damper was not removed from the box, etc), and it especially has not been installed to a vehicle. 

Cancellation of an order that has not yet shipped is subject to a 5% cancellation fee. Products are not guaranteed to be in stock, and any cancellations of back ordered items will be subject to the 5% cancellation fee.

Custom made or customized items are not eligible for return under any circumstance.

Orders with mismatched billing and shipping addresses will be cancelled and not fulfilled.

Shipping

Shipping rates are provided live by UPS. Delivery dates for any shipping option are not guaranteed. Attempts will be made to ship orders same day when possible for orders placed before 3pm CST. Orders are fulfilled in the order they are received; any shipping option quicker than ground will increase the priority of the order relative to ground shipments. Items shipping to a unit number will be shipped signature required. DSX Tuning is not liable for delivery issues that arise after UPS has taken custody of the package; any concerns with delivery (lost packages, non-delivery) will require the recipient to file a claim with UPS before DSX Tuning will begin to process replacements or reimbursements.

Warranty

DSX Tuning manufactured products are covered against defects in manufacturing and assembly for the life of the product for the original purchaser. This warranty is not inclusive of damage that is due to user/installation error, negligence, or environment (force majeure). Electronic devices are designed as IP60 and are not to be considered waterproof or submersible; they should be kept in dry places and away from direct water contact. Wire harnesses are designed as abrasion resistant but not abrasion proof, and damage from cuts, rubbing, pulling/stretching, or excessive bends are not covered under warranty. Fuel lines are to be protected and will not be warrantied for cut/rub/impact damage. Idler pulleys are warrantied and/or rebuilt on discretion due to the bearings being a non DSX manufactured piece and due to the extreme nature of most aftermarket belt drive systems. Modification of any component immediately voids the warranty of the entire product and not just the component.

Certain components of DSX Tuning products that are not manufactured by DSX Tuning are subject to a 90 day warranty from receipt of the product. This includes flex fuel sensors, fuel pumps, and GM parts (tensioners, pulleys, fuel pumps, injectors, etc). 

All other products not manufactured by DSX Tuning are subject to the manufacturer's warranty and are handled at the discretion of the manufacturer. DSX Tuning does not have the ability to override a manufacturer's warranty.

 

 

 

European Union Consumer Right of Withdrawal

This section applies only to individual consumers residing in the European Union who purchase eligible products from DSX Tuning through dsxtuning.com for purposes outside their trade, business, craft, or profession.

This section supplements DSX Tuning’s standard Refund Policy. Where this section conflicts with the standard Refund Policy, this section will apply to the extent required by applicable European Union or national consumer-protection law.

This section does not apply to business customers, dealers, resellers, distributors, professional installers purchasing for commercial purposes, or other customers who are not acting as consumers.

Your Right to Withdraw

You have the right to withdraw from an eligible purchase within 14 days without providing a reason.

For an order containing one product, the withdrawal period expires 14 days after the day on which you, or a person designated by you other than the carrier, physically receives the product.

For an order containing multiple products delivered separately, the withdrawal period expires 14 days after the day on which you, or a person designated by you other than the carrier, physically receives the last product.

To meet the withdrawal deadline, you must notify DSX Tuning that you are exercising your right of withdrawal before the applicable 14-day period expires.

Your notice should include enough information for us to identify you and the applicable order, such as your name, email address, order number, and the products you wish to return.

You may use the model withdrawal form at the end of this section, but its use is not mandatory.

When you submit a withdrawal request through our electronic withdrawal function, we will promptly acknowledge receipt using a durable medium, such as email.

Submitting a withdrawal request does not necessarily stop shipment if an order has already entered processing or fulfillment. If the order has shipped, you must return the eligible products in accordance with the instructions below.

Returning Automotive Parts

After notifying us of your withdrawal, you must send the products back without undue delay and no later than 14 days after the day on which you notified us of your decision to withdraw.

Unless DSX Tuning provides different return instructions in writing, products should be returned to:

Before shipping a return, please contact us or submit an electronic return request so that we can provide return instructions and any required return authorization information.

The return deadline is met if you send the products before the 14-day return period expires.

You are responsible for the direct cost of returning the products unless:

  • the products are defective, damaged, incorrect, or otherwise not in conformity with the sales contract;

  • DSX Tuning agreed to pay the return cost; or

  • applicable law requires DSX Tuning to bear that cost.

International return shipping for automotive components may be expensive. Return costs may vary significantly based on the product’s dimensions, weight, value, hazardous-material classification, and destination. You are responsible for obtaining an appropriate return-shipping quotation before sending the product.

Products must be securely packaged and returned with all components, accessories, hardware, instructions, documentation, and original packaging that remain in your possession.

You should not install, wire, program, tune, modify, disassemble, damage, contaminate, or operate a product beyond what is reasonably necessary to establish its nature, characteristics, compatibility, and functioning.

Installed, Tested, or Handled Parts

Opening a package does not, by itself, eliminate your statutory right of withdrawal.

However, you may be responsible for any reduction in a product’s value caused by handling beyond what would reasonably be permitted when examining the product in a physical retail store.

Depending on the circumstances, diminished value may result where a product has been:

  • installed on or connected to a vehicle;

  • used while the vehicle was operated;

  • exposed to fuel, oil, coolant, exhaust, heat, road debris, or other automotive fluids or conditions;

  • programmed, flashed, married, licensed, registered, or permanently associated with a vehicle, controller, VIN, user account, or third-party software account;

  • scratched, bent, cut, drilled, welded, painted, coated, crimped, spliced, trimmed, or otherwise modified;

  • assembled using thread locker, sealant, adhesive, gaskets, crush washers, clamps, or fittings;

  • subjected to electrical current, fuel pressure, boost pressure, mechanical load, or engine operation;

  • returned with missing components, damaged packaging, or other loss of value attributable to unnecessary handling.

Any deduction for diminished value will be based on the actual reduction in value caused by the handling and will not be imposed as an automatic restocking fee.

A product is not automatically excluded from the statutory withdrawal right merely because DSX Tuning’s standard policy describes it as “opened” or because its original packaging has been disturbed.

Vehicle Compatibility

You are responsible for reviewing the product description and providing accurate vehicle, engine, transmission, model-year, fuel-system, tuning-platform, and other configuration information when placing your order.

A customer’s mistaken selection of an otherwise standard, eligible product does not automatically eliminate the statutory right of withdrawal.

However, products manufactured, configured, programmed, machined, assembled, or modified specifically for your vehicle or specifications may fall within the personalized-goods exception described below.

Nothing in this section limits your rights where DSX Tuning supplied a product that was incorrectly described, incompatible despite accurate information being provided, defective, damaged, or otherwise not in conformity with the sales contract.

Refunds

If you validly exercise your right of withdrawal, DSX Tuning will reimburse payments received from you for the withdrawn products, including the cost of the least-expensive standard delivery method offered for the original order.

If you selected expedited, priority, express, or another delivery method that was more expensive than our least-expensive standard delivery option, we are not required to refund the additional delivery cost.

We will issue reimbursement without undue delay and no later than 14 days after the day on which we receive notice of your decision to withdraw.

For purchases involving physical products, we may withhold reimbursement until either:

  1. we receive the returned products; or

  2. you provide satisfactory evidence that you sent the products back,

whichever occurs first.

Unless otherwise agreed, reimbursement will be made using the same payment method used for the original transaction. You will not be charged a reimbursement fee.

No cancellation fee, administrative fee, or automatic restocking fee will be deducted solely because an eligible EU consumer exercised the statutory right of withdrawal.

A deduction may be made for an actual reduction in value caused by handling beyond what was reasonably necessary to inspect the product.

If only part of an order is withdrawn, any refund of the original delivery charge will depend on whether the delivery charge would have been the same for the products you retain and on the requirements of applicable law.

Any import duties, brokerage charges, customs fees, taxes, or similar government charges collected directly by a carrier or governmental authority may need to be reclaimed from that carrier or authority. This does not affect any refund that DSX Tuning is legally required to provide.

Products and Contracts That May Be Excluded

The right of withdrawal does not apply where a legally recognized exception applies and all requirements for that exception have been satisfied.

For DSX Tuning products and services, possible exceptions may include:

Custom-Manufactured or Personalized Parts

Products made to the consumer’s specifications or clearly personalized may be excluded. This may include parts that are specially machined, fabricated, assembled, configured, engraved, modified, painted, coated, programmed, calibrated, or otherwise produced specifically for the customer’s vehicle or instructions.

Selecting a standard product from ordinary stock options does not necessarily make the product personalized.

Custom Tuning and Calibration Services

A tuning, calibration, diagnostic, dyno, installation, fabrication, or other service may lose its withdrawal right after the service has been fully performed where:

  • performance began with the consumer’s prior express request or consent; and

  • the consumer acknowledged that the right of withdrawal would be lost once the service was fully performed.

Where the service has begun but has not been fully performed during the withdrawal period at the consumer’s express request, the consumer may be required to pay a proportionate amount for the service already supplied, where permitted by law.

Digital Content and Downloadable Files

Digital tuning files, calibration files, firmware, software, license keys, data files, downloadable instructions, or other digital content not supplied on a physical medium may be excluded after delivery begins where:

  • the consumer gave prior express consent to immediate delivery;

  • the consumer acknowledged that beginning delivery would cause the loss of the right of withdrawal; and

  • the required confirmation was provided.

Merely stating that a digital product is “nonrefundable” is not sufficient unless the applicable consent and acknowledgment requirements have been met.

VIN-Locked, Account-Locked, or Activated Products

A product that becomes permanently registered, activated, licensed, VIN-locked, married, or linked to a vehicle or user account is not automatically exempt merely because activation occurred.

Whether the product is excluded, subject to a diminished-value deduction, or returnable will depend on the nature of the product, the information given before purchase, the customer’s actions, and applicable law.

Sealed Software or Media

Sealed computer software, audio recordings, or video recordings may be excluded after the seal has been broken, where the applicable legal requirements are met.

Urgent Repairs or Maintenance

Where a consumer specifically requests an urgent visit for repairs or maintenance, the right of withdrawal may not apply to the urgent work or replacement parts necessarily used to perform that work. Additional products or services supplied beyond the consumer’s urgent request may remain subject to withdrawal rights.

Other Statutory Exceptions

Other exceptions provided by applicable law may apply depending on the nature of the product or contract.

An exception will be applied only when its legal requirements are satisfied. A product is not excluded merely because DSX Tuning labels it custom, special-order, electronic, opened, installed, final sale, or nonreturnable.

Defective, Damaged, Incorrect, or Nonconforming Products

The 14-day right of withdrawal is separate from your legal rights concerning defective, damaged, incorrect, misdescribed, incompatible, or otherwise nonconforming products.

Nothing in this policy limits any mandatory legal guarantee or remedy available under applicable European Union law or the law of your country of residence.

Depending on applicable law and the circumstances, available remedies may include repair, replacement, price reduction, contract cancellation, or reimbursement.

You should contact DSX Tuning promptly if you believe a part is defective or incorrect. We may reasonably request photographs, diagnostic information, data logs, vehicle information, installation information, or return of the product so that the issue can be evaluated.

Any diagnostic process or manufacturer-warranty process does not replace or restrict mandatory consumer rights.

Statutory Rights Control

This section does not exclude, waive, or restrict any mandatory consumer right.

Any provision of DSX Tuning’s standard Refund Policy—including its cancellation fees, restocking fees, unopened-product requirements, original-shipping exclusions, return deadlines, warranty restrictions, or customer-paid return terms—will apply to an EU consumer only to the extent that the provision is consistent with mandatory applicable law.
